What Is ACO REACH?
ACO REACH (Accountable Care Organization Realizing Equity, Access, and Community Health) is a voluntary Medicare payment model administered by the Centers for Medicare & Medicaid Services (CMS) through the Center for Medicare & Medicaid Innovation (CMMI).
ACO REACH is designed to improve care coordination, reduce costs, and advance health equity for Medicare fee-for-service beneficiaries. Participating organizations — called Direct Contracting Entities (DCEs) or ACO REACH participants — take on accountability for the quality and cost of care for aligned Medicare beneficiaries.
Nivano Physicians participates in the ACO REACH model as Standard ACO.
Your Rights as a Medicare Beneficiary
Participation in ACO REACH does not change your Medicare benefits. As a Medicare fee-for-service beneficiary whose care is coordinated through Nivano Physicians’ ACO REACH participation, you retain all of your standard Medicare rights and protections, including:
- The right to see any Medicare-participating provider — you are never required to see only providers in our network
- The right to all Medicare-covered services you are entitled to
- The right to make your own healthcare decisions without interference
- The right to not be billed for services that Medicare covers
- The right to file complaints about your care or your rights
- The right to be treated with dignity and respect regardless of your health status, age, race, ethnicity, or disability
What ACO REACH Means for Your Care
As part of ACO REACH, Nivano Physicians works with your primary care physician and care team to:
- Coordinate your care across primary care, specialist, urgent care, and hospital settings
- Review your health information to identify preventive care opportunities and manage chronic conditions
- Reduce care gaps and improve transitions between different care settings
- Advance health equity by ensuring access to care for underserved populations
Your care team may proactively reach out to you about preventive care, follow-up appointments, or care management programs as part of ACO REACH activities.
How Beneficiary Alignment Works
Medicare beneficiaries are assigned (“aligned”) to ACO REACH participants based on their pattern of primary care utilization. You are not required to formally enroll in the ACO REACH model — alignment happens automatically based on your claims data.
You may be aligned to Nivano Physicians’ ACO REACH if your primary care physician is part of our network and you receive a plurality of your primary care from that physician.

Your Right to Opt Out of Data Sharing
As part of ACO REACH, CMS shares certain Medicare claims data with Nivano Physicians to help coordinate your care. This data sharing is authorized under the Medicare program.
If you do not want CMS to share your Medicare data with Nivano Physicians for ACO REACH purposes, you have the right to opt out of this data sharing. To opt out, contact CMS directly:

Opting out of data sharing will not affect your Medicare coverage or your ability to receive care from any Medicare-participating provider.

CMS maintains oversight of all ACO REACH participants and monitors quality, equity, and financial performance. If you have concerns about your care or believe your rights have been violated, you may contact CMS directly.
Quality and Equity Commitments
As part of our ACO REACH participation, Nivano Physicians is required to:
- Report quality measures to CMS, including patient experience and clinical outcome measures
- Develop a Health Equity Plan to identify and address disparities in care for underserved populations
- Screen beneficiaries for social needs that affect health (such as food insecurity and housing instability) and connect them with community resources
- Submit data on race, ethnicity, language, and social determinants of health to support CMS equity initiatives
Conflict of Interest and Compensation Disclosure
There are no joint ventures between or among the ACO and any of its ACO Participant Providers or Preferred Providers.
Shared savings are distributed as follows: 40% is reinvested in ACO infrastructure; 30% is invested in redesigned care processes and resources to improve outcomes and reduce Medicare costs for beneficiaries; and 30% is distributed to ACO Participant Providers. In Performance Year 2023, net shared savings distributed to participants totaled $2,370,765.45.
